Another thing I wanted to add. My brother, who is a Marine. Well, he has angry spells where he starts to become violent; sometimes suddenly. And sometimes I hear him yell, No!, in his sleep. He was in Iraq and Afghanistan, and did this while medical problems with my father began, as that is when the injury happened. My thinking is the extra stress from my father being ill, made combat harder for him and I think it contributed to his issues.

He get's violent at times. It looks like PTSD or something like that to me, but I am not a professional psychologist, and he's not making any effort to see one, and I can't do it for him. In fact I try to stay away from him, because I am afraid he will do something he will regret later; because of his anger.

My mother on the other hand shops, to make her self feel better.

I can't do anything. There are too many damaged people in my family because of this. I don't know what to do. Honestly, the doctors say we should DNR him. I would have to do that against my families wishes, as they want to keep my father around, as I do too, but not like this.

I might be able to over-ride my families wishes,but I am afraid of creating any further damage to my family.

It really seems to me like I should get my brother to a psychologist. It is likely unpractical to think that there is someone that has been through this before with all the answers.

The issue with my father will likely have to be worked out slowly. I am divided by what the doctors want and what may family wants.

In honesty it looks to me that nothing I do will make a difference to the larger picture. I will stop fighting for my father to receive extra treatment though. Unless my mother brings me something that is supported by the medical community. (this is the hardest part)

I feel that parts of my Anxiety is from dealing with people on the verge of their breaking point. It's also hard not knowing what I am doing here, or what I am doing it for.

He got better, then aspirated, then went to the hospital and he will be back in the nursing home. I am re-evaluating his insurance to give him another years worth of care. I am at the point where I don't want to go to the hospital anymore.

This has been the worst 5 years of my life, and all because of one crappy doctor. We didn't recover anything, because of an issue with the attorneys and fraud on the court. In retrospect I should have done more, but got so tired, that I failed to be able to. My heart is hurt by this, my family lost everything paying for his care. I should have appealed, even with the fraud issues. It was my attorney that tried to kill the case continued to interfear with it, when I tried to act on my own. And I was really outclassed, when I went up against the 3 attorneys as a pro sae litigant.
The conclusion has been: (this is from a medical expert, named are x'd out)

It is my opinion within reasonable medical probability that the nursing staff and/or the respiratory therapist breached the standard of care in the following areas:


  1. Failed to document the reason for the increase in FIO2 from 40% to 65% at 8:35 p.m. on 07/18/07
  2. Failed to report to the nurse and/or the physician the elevated heart rate of 113/minute at 8:35 p.m.
  3. Failed to report to the physician the elevated heart rate in the 120’s and respiratory rate of 34/minute at 10:45 p.m. on 07/18/07
  4. Failed to assess Mr. XXXX at midnight on 07/18/07 related to the decreasing oxygen saturation of 92% on an FIO2 of 65% and at 1:00 a.m. on 07/19/07.
  5. Failed to call the physician at 2:45 a.m. on 07/19/07 when it was noted that the oxygen saturation could not be kept above 90% making it necessary to increase the FIO2 to 100%
  6. Failed to follow physician orders related to the Dilaudid frequency of every 4 hours by giving it at 8:00 p.m. and then again at 10:50 p.m. on 07/18/07, less than 3 hours between doses
  7. Inappropriately administered Hydrocodone tablet at 2:30 a.m. on 07/19/07 and then Dilaudid 2mg IV at 2:50 a.m. The Hydrocodone would have had its peak effect at 3:30 a.m. and the Dilaudid would have had its peak effect some where between 3:20 a.m. and 3:50 a.m. These medications cause respiratory depression and when given too closely together will exacerbate the respiratory depression that Mr. XXXX was already experiencing
  8. Inappropriately administered multiple narcotics, which cause decreased respirations, when Mr. XXXX had respiratory difficulties with decreased oxygen saturations
  9. Failed to do a timely follow up assessment after 2:45 a.m., when the oxygen saturation would not stay above 90% necessitating an increase in the FIO2 to 100%, and instead waited to recheck Mr. XXXX at 3:15 a.m. at which time Mr. XXXX was found to have substernal breathing
  10. Failed to call a physician when the oxygen saturation is noted to be 40% at 3:30 a.m.
  11. Failed to call an in-house physician when the oxygen saturation began dropping sometime prior to it getting down into the 40’s at 3:30 a.m. Failed to call an in-house physician when the oxygen saturation went down into the 30’s at 4:10 a.m.
  12. Inappropriately caused a delay in intubation by not calling an in-house physician and instead waited until 5:15 a.m. for the physician to arrive resulting in a delay in intubation at 5:28 a.m.
  13. Failed to follow ACLS protocol related to medication administration for asystole.


It is my opinion within reasonable medical probability that these breaches in the standard of care resulted in or contributed to the anoxic encephalopathy that Mr. XXXX sustained.


The sad part is, we never sent him here. I believe we were mistaken for an uninsured, so my father was dumped here and killed.
